Halle Berry Drops Out of Upcoming Film to Fight for Custody of her Daughter

The custody battle for 2 1/2-year-old Nahla is getting more and more heated between parents Halle Berry and her former boyfriend Gabriel Aubry. This week Berry announced that she is leaving production for the film New Year’s Eve to fight for her daughter.

“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,” a rep for Berry told PEOPLE.

“She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”

According to PEOPLE, Aubry’s verbal abuse was what perpetuated the Oscar-winning actress to take action.

Aubry’s friend and business partner Stephane Bibeau said, “Once they broke up, he became verbally threatening to Halle. He doesn’t even realize the strength of his words. He is a vindictive guy.” Bibeau also added that Aubry used a racial slur against Berry and that he is the type to speak first and think later.

A source told TMZ, “Halle Berry claims her daughter Nahla has been crying hysterically and throwing tantrums whenever Gabriel Aubry picks the toddler up for visits. Halle is convinced something bad is happening.”

Aubry defended himself in a statement released to Access Hollywood and said, “Halle’s continuing allegations in the press are untrue and irresponsible.”

Aubry, 34, and Berry, 44, dated from 2005 to 2010. In 2008 the couple had Nahla and shared custody. Then in May of last year the model and actress split but made a commitment to maintain a friendly relationship as parents for their daughter. Aubry briefly dated Kim Kardashian and Berry is currently with French actor Oliver Martinez.

Berry’s custody battle marks her third tumultuous and public break up. She has divorced baseball star David Justice and singer Eric Benet. Both marriages had been troubled and lead Berry, who was a victim of domestic abuse, to thoughts of suicide.

In regards to the well-being of Nahla, Berry believes that when her daughter is in Aubry’s care, it is unhealthy, especially after Berry experienced Aubry putting their daughter in harm’s way while the three were in London and South Africa together, TMZ reported.
